Changes to the Conditions of Use Professional Sales via bol as of 16 February

As of 16 February 2023, we are implementing a change to the Conditions of Use Professional Sales via bol. In this message, you can read why we are doing this and which conditions are affected.

Why are we making this change?

Price is very important for customers. It is often a deciding factor in their purchase. We value reliable prices greatly, so that customers return for future purchases. To ensure customers have a positive experience on our platform, we maintain a pricing policy. This pricing policy is described in the Conditions of Use Professional Sales via bol.

 

What is changing?

In the new conditions of sale, we specify how we determine the relevant market price (RMP) when there is no list price or relevant provider. This makes the conditions clearer and more complete. Below is a brief explanation of the relevant articles and their additions.

 

Article 3 paragraph 6

In Article 3 paragraph 6, 'in principle' is changed to 'where possible'. In practice, it appears that it is not always possible to determine an RMP.

To protect bol and the Platform, bol strives for a positive price perception among its Customers. Therefore, bol determines an RMP for each item on its Platform from time to time, where possible.

 

Article 3 paragraph 6 under i

In this article, we add a section to make the article clearer and more complete. When determining the relevant market price, we try as much as possible to look at the prices for the item in the market (both on the platform and with competitors). If there is a unique offer (meaning only 1 provider sells the item), we check if there are similar items that can help us determine the relevant market price. Below, you will see the italicized text we are adding to the article.

 

i. the Selling Price of the item used by so-called ''relevant providers'' outside the Environment.

 

  • If there are 2 - 5 relevant providers, the RMP is the second-lowest Selling Price offered by these providers.

 

  • If there are > 5 relevant providers, the RMP is the third-lowest Selling Price offered by these providers.

 

  • If there are ≤ 1 relevant providers, the recommended retail price as determined by the item's supplier (hereinafter the ‘List Price’) will also be included in the RMP determination, if available. If there is 1 relevant provider and a List Price is available, the RMP will be the highest of these. If no relevant provider is available but a List Price is, the RMP will be equal to the List Price. If there is 1 relevant provider and no List Price is available, the RMP will be the price of this provider + X (X= the amount or percentage per tranche as included in column 1 of the table below, multiplied by 4). If there is no List Price or relevant provider, bol can determine the RMP by looking at the historical price development of the item and/or the price of similar items in the market (e.g., by looking at the unit price of an item when selling a bundle/value pack).
