Conditions of Use Professional Sales via bol

Article 1 – Definitions
Buy Box: a prominent sales position for an Item in the Environment as detailed on the Website for Professional Sellers.
Promotional Buy Box (New): a second prominent sales position alongside the Buy Box for highlighting a promotional offer, as further described in Article 12(2)(iv).

Article 6 (4)
If a Sale and Purchase Agreement is dissolved within the time limit mentioned in the general terms and conditions included in schedule 1 then bol shall repay the payment directly to the Customer within the time limit imposed in the said general terms and conditions. In case the Professional Seller already received the payment of this Sale and Purchase Agreement from bol, bol shall, upon refunding the Customer, immediately have a due and payable claim against the Professional Seller for an amount equal to the refunded amount. Article 12 (2) (New)
On the Platform, bol may display a Promotional Buy Box alongside the Buy Box, if both a regular offer and a promotional offer are available for an Item. The key parameters for the Promotional Buy Box are:

1. That the promotion concerns a so-called ‘X+Y free’ promotion, as described on the Website for Professional Sellers;
2. That the promotion complies with bol’s guidelines, as described on the Website for Professional Sellers;
3. Availability to order of the Item (whether the Item is available for delivery);
4. Condition of the Item (only new Items are permitted);
5. That the Professional Seller has a Quality Score of at least 65.

If multiple sellers have a promotional offer for the same Item, bol recommends one seller by taking into account:

1. The promotional price of the Items, including shipping costs and VAT; and
2. The delivery time of the Item.

Article 5 (9) (New)
Items with a limited shelf life no longer qualify as part of the eligible assortment if their remaining shelf life, taking into account the sales periods applied by bol (“Block Days”), is insufficient for the Item to continue to be offered through the Platform. The Block Days applied by bol are determined and further explained on the Professional Sellers Website.

Indien een Artikel met een beperkte houdbaarheidsdatum niet langer onder geschikt assortiment valt, kan bol deze Artikelen verwijderen en vernietigen, tenzij de Lvb Verkoper via zijn verkoopaccount tijdig een verzoek doet om de volledige voorraad van het betreffende Artikel aan hem te retourneren. Een dergelijk verzoek moet de Lvb Verkoper indienen voordat de resterende houdbaarheid van het Artikel minder bedraagt dan de toepasselijke Block Days.
