European Union Deforestation Regulation
In this article, you can read what the European Union Deforestation Regulation (EUDR) means for your items.
What does the European Union Deforestation Regulation mean?
The European Union Deforestation Regulation (EUDR) applies from 30 December 2025. In this article, you can read what this law means for your items. The European Union Deforestation Regulation (EUDR) helps combat global deforestation. Check whether your items contain raw materials for which you must prove that they do not originate from recently deforested land or contribute to forest degradation.
Which companies does the law apply to?
The EUDR applies to all companies that sell the specified raw materials or items derived from them within the EU. This concerns wood, oil palm, soy, cocoa, coffee, rubber, and cattle, as well as items derived from these. Think, for example, of books and other paper items, chocolate, furniture, or leather. Packaging around your items is excluded from this.
What does this mean for you?
You need to know where the raw materials in your items come from. What you specifically need to do depends on how the raw materials are used and the size of your business.
In Annex 1 of EU Regulation 2023/1115, you can find which raw materials and derived items fall under the EUDR. There you can check, for instance, whether chocolate in biscuits falls under the rules.
Has the raw material or item not yet been placed on the market in the EU?
Then set up a due diligence system with due diligence statements. With this, you demonstrate that your items are legal and do not cause deforestation or forest degradation.
To do this, you collect origin data, assess risks, and take measures where necessary. This can be done, for example, using certificates, extra checks, or additional information. You can set up the system yourself or hire a specialized company for this.
Has the raw material or item already been placed on the market in the EU?
Then you do not need to set up a due diligence system yourself. Your supplier or a previous party in the supply chain has already done so.
Do keep track of which supplier you purchase items or raw materials from, and ensure you receive the reference numbers of your suppliers' due diligence statements. Are you a micro or small enterprise? Then you are required to keep these records. Keep the documentation for at least 5 years.
What if you do not comply with the EUDR?
The NVWA checks whether the EUDR is complied with in the Netherlands. Is the correct information missing? Then the NVWA can request bol to take action. We may then, for example, take items offline or deduct policy points.
What is your responsibility?
You are personally responsible for complying with the EUDR. We help you with explanations and references, but this information does not constitute legal advice.
Do you have specific questions? Please contact a legal advisory firm. Here you can find ecosystem partners that can help you.
Partnerservice cannot advise you on this, as it concerns European legislation.
