What's changing in our terms and conditions this new quarter

Effective August 1st and September 1st, 2023, several clauses of the Terms and Conditions Shipping via bol, Logistics via bol, and Professional Sales will be amended. These have been drafted to ensure the quality of the platform. In this message, you can read which conditions are affected and what changes.
Terms and Conditions Shipping via bol
Article 10, paragraphs 1 and 2 of the Terms and Conditions Shipping via bol will change as of August 1st as follows:
1. For the execution of the Shipping via bol service, bol.com must provide certain data of the Shipping via bol Partner to the carrier(s) that the Shipping via bol Partner uses. This concerns the following data:
- Name of Shipping via bol partner (shop name & contact person's name);
- Address (street, house number & suffix, postal code, city);
- Phone number;
- Email address;
- Sales account number.
2. The carrier, which the Shipping via bol Partner uses, can contact the Shipping via bol Partner by email, phone, and WhatsApp regarding the transport assignment and to share information about Shipping via bol, e.g., about changes in the opening hours of the drop-off points or changes in pickup times. For more information about the use of data by the carrier, you can consult the privacy statement on the carrier's website.
Terms and Conditions Logistics via bol
Paragraph 11 will be added to Article 5 of the Terms and Conditions Logistics via bol as of September 1st:
11. As soon as bol.com receives a notification that an item must be recalled, it will return the recalled item to the Logistics via bol Partner. If the Logistics via bol Partner fails to receive the recalled item twice, bol.com may destroy the recalled item without any compensation being due to the Logistics via bol Partner.
Terms and Conditions Professional Sales
Article 10, paragraph 3 of the Terms and Conditions Professional Sales will change as of September 1st as follows:
3. Some data generated by bol.com on the platform will be provided to third parties to enable them to map the online sales market. This concerns information about (parts of) the online sales market not traceable to individual Professional Sales Partners. The data shared with third parties is limited to revenue and sales figures over a selected period. bol.com provides this information based on a legal obligation or commercial considerations. Additionally, bol.com may, if legally obliged, provide (personal) data about Professional Sales Partners, including revenue and sales figures and Chamber of Commerce numbers, to a government authority. This concerns information traceable to individual Professional Sales Partners.
Terms and Conditions Professional Sales
Article 15, paragraph 4 of the General Terms and Conditions for Professional Sales (Appendix 1 of the Terms and Conditions) will change as of September 1st as follows:
4. If the Buyer, residing or established in the Netherlands, fails to meet their payment obligation(s) in time, after bol.com has notified them of the late payment and granted the Buyer a period of 14 days, commencing the day after receipt of the reminder, to still fulfill their payment obligations, after failure to pay within this 14-day period, statutory interest will be due on the outstanding amount, and bol.com is entitled to charge the extrajudicial collection costs incurred by it. These collection costs amount to a maximum of: 15% on outstanding amounts up to € 2,500; 10% on the subsequent € 2,500; and 5% on the subsequent € 5,000, with a minimum of € 40. bol.com may deviate from the stated amounts and percentages in favor of the Buyer.
If the Buyer, residing or established in Belgium, fails to meet their payment obligation(s) in time, they will receive a free reminder from bol.com. If the Buyer does not pay within the foreseeable payment term as stated in the first reminder, the Buyer will be charged default interest, as determined by the Act of 2 August 2002 on combating late payment in commercial transactions, as well as a fixed compensation as follows:
- € 20,- if the outstanding balance is less than or equal to € 150,-;
- € 30,- plus 10% of the amount due on the tranche between € 150.01 and € 500,- if the outstanding balance is between € 150.01 and € 500,-; and
- € 65,- plus 5% of the amount due on the tranche above € 500,- with a maximum of € 2,000,- if the outstanding balance is greater than € 500,-.
The reminder fees for each additional reminder amount to €7.50, increased by the applicable postage costs at the time of sending.
Terms and Conditions Professional Sales
Article 15, paragraph 4 of the General Terms and Conditions for Professional Sales (Appendix 1 of the Terms and Conditions) will change as of September 1st as follows:
4. If the Buyer, residing or established in the Netherlands, fails to meet their payment obligation(s) in time, after bol.com has notified them of the late payment and granted the Buyer a period of 14 days, commencing the day after receipt of the reminder, to still fulfill their payment obligations, after failure to pay within this 14-day period, statutory interest will be due on the outstanding amount, and bol.com is entitled to charge the extrajudicial collection costs incurred by it.
