Trademark Law

If you want to use your brand on bol, it's important that your brand is registered with the Benelux Office for Intellectual Property (BOIP). If you register your name or logo as a brand, you get the exclusive right to use that brand for your own items. Other partners may sell your brand, but they are not allowed to put it on their own items or use it as if it were theirs. Only you, as the brand owner, are allowed to do that.

By registering your brand, you can take action against other brands that strongly resemble your brand. If brands emerge that confusingly resemble your registered brand, you can take steps to protect your own brand. This helps to maintain your brand's unique identity and prevent customer confusion.

In short, brand registration not only gives you ownership rights but also the ability to act against brands that are very similar to yours. It's an important step to protect the value and recognition of your brand on bol.

Conditions

Please note that your brand name must meet the following conditions:

  • The brand is registered with the BOIP (or EUIPO/WIPO);
  • The brand is registered in the correct product class. Your brand must be registered for a product class lower than 35. Product classes 35 to 45 are only valid for services and not for goods;
  • The item must also be registered in this class under the mention of the correct goods;
  • Your registration is valid in the Netherlands and Belgium;
  • Your brand must meet the above points from the moment the item is added on bol.

Enter the brand name in the brand field when entering the content. Do this in text, even if you have only registered your brand as a logo mark.

The use of a brand name not registered with the BOIP for an item is not allowed. No rights can be derived from it.

Trademark Rights

Your content must not infringe on the rights of brand owners. It is not allowed to mention brand names or product names of branded items with items that are not of that brand. Mentioning other brand names or product names with your item will be considered a content violation.

Exception: it is allowed to mention other brands and items with the prefix; “suitable for…” if this is essentialfor the sale of the item. It is essential for the sale when an item is an accessory to another item and is only suitable for use with that specific item.
