Changes to our Conditions of Use this coming quarter

With the Conditions of Use, we guarantee the quality of our platform. Effective February 17, 2024, we are adjusting some conditions in the Conditions of Use Professional Sales via bol. In this message, you can read which conditions are affected and what changes.

In the Conditions of Use Professional Sales via bol articles 1, 2.4 sub g and h, and 3.6 are amended as follows: Article 1 – Definitions
Professional Partner(s): any legal entity that has been registered for at least 10 weeks with the Chamber of Commerce in the Netherlands or the trade register in Belgium and has a VAT number, a postal address in the Netherlands and/or Belgium, and a bank account in a SEPA country, has created a seller account, has accepted these Conditions of Use, and has been accepted as a partner by bol.com, and whose (indirect) director(s), shareholder(s) and/or ultimate beneficial owner(s) have not previously been involved in another seller account that was closed pursuant to article 15 of the Conditions of Use, and whose (indirect) director(s), shareholder(s) and/or ultimate beneficial owner(s) have reached at least the age of 18.

MTP: the maximum allowed price.

 

Article 2 - Seller account

  1. Every Professional Partner must create a seller account before they can offer and sell items on the Platform.
  2. bol.com is at all times entitled, without stating reasons, not to grant a seller account to a Professional Partner and/or to impose additional requirements for granting a seller account.
  3. Registration as a Professional Partner implies acceptance of the Conditions of Use and the obligation to comply with the Conditions of Use and the information on the Website for Professional Partners.
  4. To act as a Professional Partner, the Professional Partner must:
    • a. Have been registered for at least 10 weeks with the Chamber of Commerce in the Netherlands or the trade register in Belgium;
    • b. Possess a valid VAT number;
    • c. Possess a login account with bol.com;
    • d. Have created a seller account in the Environment;
    • e. Confirm that the Conditions of Use have been accepted;
    • f. Confirm that the (indirect) director(s), shareholder(s) or ultimate beneficial owner of the seller account have not been involved in another seller account that was closed pursuant to article 15;
    • g. Confirm that the (indirect) director(s), shareholder(s) or ultimate beneficial owner(s) have reached at least the age of 18;
    • h. Possess a bank account in a SEPA country;
    • i. Possess a Dutch or Belgian postal address.
  5. From the moment the seller account is created, the Professional Partner is entitled to offer items on the Platform in accordance with the Conditions of Use.
  6. The Professional Partner can only participate with one (1) brand/trade name per seller account. If the Professional Partner wishes to offer items via the Platform under multiple brands/trade names, the Professional Partner must create multiple seller accounts.
  7. The Professional Partner is at all times fully responsible for the use of the seller account and for those who gain access to the seller account. bol.com is at all times authorized, for its own compelling reasons, to suspend the use of the seller account by the Professional Partner, with due observance of the provisions in article 15 of the Conditions of Use.
  8. If the Professional Partner fails to meet any payment obligation towards bol.com, whether or not arising from these Conditions of Use, bol.com is entitled to suspend the use of the seller account by the Professional Partner (in accordance with article 15 of the Conditions of Use) until the payment obligation has been met.
  9. The Professional Partner is responsible for the accuracy of the data in their seller account.

 

Article 3 - Offerings

  1. The Professional Partner can offer new and second-hand items. The items must comply with the conditions as stated on the Website for Professional Partners.
  2. bol.com is solely entitled to determine which product categories and/or subcategories may be offered on the Platform and/or can be added to the Platform, as well as from what time this will be possible. Furthermore, bol.com is entitled to remove product categories and/or subcategories from the offerings on the Platform, without the Professional Partner being able to assert any right against bol.com as a result. bol.com reserves the right to exclude certain items from the product categories and/or subcategories, stating reasons.
  3. The product categories and/or subcategories that have been and/or will be opened by bol.com are listed on the Website for Professional Partners, which Website, including the product categories and/or subcategories, may be unilaterally changed by bol.com from time to time, with due observance of the provisions in article 21 paragraph 3 of the Conditions of Use.
  4. bol.com is free, stating reasons, to no longer allow the Professional Partner to offer certain items on the Platform. The Professional Partner will immediately cease and keep ceased the offering of the item concerned upon bol.com's request. If the item is still offered on the Platform despite this, bol.com is entitled to remove the offering of the item concerned itself.
  5. bol.com is entitled to remove a specific item from a Professional Partner from the Platform if this item is deemed to be below standard, as indicated on the Professional Partner's seller account. You can find here when bol.com believes an item performs below standard.
  6. To protect bol.com and the Platform, bol.com strives for a positive price perception among its customers. Therefore, bol.com sets a maximum allowed price (MTP) for each item on its Platform from time to time, where possible. bol.com does not display items with a price above the MTP on the Platform. The main parameters bol.com uses to determine the MTP are:
    • Competitive market prices; the price relative to the competition (both on and outside the platform).
    • Historical platform prices; prices that have been applied on the Platform in the past (such as maximum, minimum, and average prices; whether or not at the time of the item's introduction).
    • Recommended retail prices; determined by the manufacturer or starting prices used in the market by distributors.
    • Prices (including MTP) of comparable items on and outside the Platform (e.g., comparable model, color variants, etc.).
      bol.com may add new parameters to determine the MTP, whether as a test or not. It will inform the Professional Partner about this via the Website for Professional Partners.
  7. bol.com will not display second-hand items from the Professional Partner on the Platform if the selling price of the item is higher than the selling price of the same item currently offered as new in the buy box on the Environment, if applicable.
  8. bol.com is entitled not to include the offering or certain information provided by the Professional Partner regarding the offering on the Platform, or to remove it from the Platform, if, in bol.com's opinion, it is incorrect or misleading, or is done in violation of these conditions, or may, in bol.com's opinion, be harmful to the good name of bol.com, the Platform, or third parties.
  9. The Professional Partner will offer free returns to customers and will never charge return costs separately.

 

Due to DSA legislation, articles 15, 19, and 21 of the *Conditions of Use Professional Sales via bol* will also change as of February 17, 2024. Read all about the DSA and the changes to the conditions as a result.
